Terms and Conditions of Sale
1. Limited Warranty - Summit Direct® and Hawk Systems™. Summit Direct warrants the hardware in any Summit Direct or Hawk built
computer system to be free from defects in materials and workmanship for a period of one year parts and five years labour only (7 years labour for
Hawk Systems™) from the date of purchase. Summit Direct’s obligation under this warranty is limited to repairing or replacing, as its own sole optio
efective hardware. This warranty does not apply to hardware which has been damaged by accident, negligence, or mis-application or has
been altered or modified in any way and does not apply to any problems encountered due to: a) software error or incompatibility; or b) hardware
incompatibility in upgrades performed after purchase. Software is not covered under any such warranty. Any product to which this warranty applies
must be returned to Summit Direct with transportation charges prepaid and must be accompanied by a brief description of the problem encountered
and proof and date of purchase. This warranty applies only to the original purchaser. Any item must be returned (with unremoved labels) in its original
packaging.
2. Warranty - All Other Products. All products other than the above (including any hardware, components or software) are purchased subject
solely to the manufacturer’s or licensor’s warranty and is accepted by the customer in lieu of all other warranties, express or implied. Removal of labels
from products will void warranty.
3. Availability of Warranted Products. Where any product is returned under warranty and the defective product (or component thereof) is
unavailable from the manufacturer for replacement, the customer agrees to: a) pay the difference in price for any substituted product or component; or
where the product is returned after 30 days from its invoice date, the difference will reflect the product’s depreciation from its current market price as
determined by Summit in its sole discretion; or b) where the product or component is repairable, leave the product with Summit Direct until repairs can
be made. Please allow approximately four to six weeks for return of product sent to manufacturer. Any items found not to be defective are subject to a
$20.00 testing and handling fee. Any item must be returned (with unremoved labels) in its original packaging.
4. Refunds and Discrepancies. The customer may return any item purchased within 7 days of the date of purchase and receive a credit to his
or her account, subject to a 15% restocking charge. No cash refunds, or returns after the 7 day period above, are allowed. Any item returned must be
in its original condition accompanied by proof and date of purchase, together with the original packing with unremoved labels (software and printer
cartridges/consumable must be unopened). Any discrepancies between this invoice and the product received must be reported within 7 days from
date of purchase, otherwise the customer is deemed to have accepted this invoice as accurate. REMOVAL OF LABELS FROM ITEMS WILL VOID
WARRANTY.
5. No Other Warranties. Except for the express warranties set forth above, no other warranties or conditions (express or implied, arising by
statute or otherwise in law or from a course of dealing or usage of trade) are made or given. In particular, Summit Direct hereby specifically declaims
any implied warranty or condition of merchantability, merchantable quality, or fitness for any purpose, particular, specific or otherwise. This invoice
constitutes the entire agreement between Summit Direct and the customer.
